Your privacy is a priority at YCharts. In this privacy policy (“Privacy Policy”) we explain our practices regarding the information that we collect through our website ycharts.com (the “Site”) from users, including you, how that information may be used, and with whom it may be shared. Capitalized terms not defined in this Privacy Policy have the meanings given in our Terms of Use located at https://ycharts.com/about/terms. We reserve the right to update this Policy from time-to-time. When we post changes to this Privacy Policy, we will revise the ‘Last Updated’ date at the top of this Privacy Policy. Any modifications to this Policy will be effective upon our posting of the updated terms. We recommend that you check our Site from time to time to inform yourself of any changes in this Privacy Policy.

The Site may contain links to other websites or applications (“Linked Sites”) that are not owned or operated by YCharts. We do not control the collection or use of any information, including Personal Information, which occurs while you visit Linked Sites. YCharts is not responsible for the content or the privacy policies of any Linked Sites, and we make no representations or warranties about their privacy practices. We encourage you to be aware when you leave our Site and to read the privacy policies of any Linked Site you visit.

User Consent

By visiting our Site, you agree to the terms of this Privacy Policy, and you expressly consent to the collection, use and disclosure of your information, including Personal Information, in accordance with this Privacy Policy. For the purposes of this Privacy Policy, “Personal Information” (also referred to as “PII” or “Personal Data”) means any information relating to an identified or identifiable natural person. A “data subject” is an identified or identifiable natural person. We do not consider Personal Information to include information that has been deidentified or anonymized so that it does not identify a specific person.

Geography

YCharts is a U.S.-based company that offers its services (“Services”) to domestic and international business customers. “Services” means having a limited nonexclusive and nontransferable license to use YCharts service software and data. As a result, information that we collect, including Personal Information, may be transferred to our U.S. offices to permit us to comply with our legal and contractual obligations, to provide information and Services to prospective and current clients, and to perform related business activities. In addition, we may provide information to third-party service providers in the U.S. and in other countries to the extent necessary to support our business activities, and we may access Personal Information collected by our customers to support the Services that we provide to our customers. Thus, Personal Information may be transferred to and stored on servers located in the United States and in countries different from the country in which that information was initially collected, which includes countries that may not offer an adequate level of data protection from an EU, UK, or Swiss perspective. Similarly, information we collect may be accessed by YCharts and our third-party service providers and business partners from countries other than the ones in which the information is stored. In the event we transfer Personal Information outside the EEA, UK or Switzerland, we will do so in accordance with the terms of this Privacy Policy and applicable data protection law, for which we may use standard contractual clauses approved by the European Commission and the UK Information Commissioner’s Office and/or adjusted according to Swiss law.

What information do we collect?

In general, when you visit the Site we may collect your IP address and standard web log information, such as the pages you accessed on our Site. We may also collect certain geo-location information. If you do not agree to our collection of this information, you may not be able to use our Services. When you register and open an account to use one of our Services, we may collect the following information from you:

  • Identification information such as your name, professional information, place of work, e-mail address, telephone number, and home address.
  • Financial information such as your payment method if you transact business with us (valid credit card number, type, expiration date or other financial information).
  • We record certain information and store it in log files when you interact with our Services. This information may include Internet protocol (IP) or other device addresses or ID numbers as well as browser type, Internet service provider, URLs of referring/exit pages, operating system, date/time stamp, information that you search for, your locale and language preferences, your mobile carrier, and system configuration information. We and our analytics providers, also collect and store analytics information when you use our Services to help us improve our Services.
  • We may require additional information from you before permitting you to use our Services to verify your identity or to manage risk and compliance throughout our relationship. We may also obtain information about you from third parties such as identity verification, fraud prevention and similar Services.
  • When you use our “Community” feature, we collect Personal Information related to your profile and activity. This may include your name, contact information, and professional details you provide. We also collect information about your use of the Community, such as which dashboards you join, content you view, and your interactions with other users and asset managers. For certain Community features, we may collect detailed analytics about your use of the Services, which may include clickstream data, securities you search for, and portfolio compositions you view.
  • We do not offer our Service or promote the Site to, nor do we intentionally collect or retain Personal Information from, children who are younger than 18 years of age. If we discover that we have inadvertently collected information from a child under 18 years of age, we will promptly take all reasonable measures to delete such information from our systems.

What should I know about “Cookies”?

We use various technologies to collect information, including cookies that we save to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory. We use cookies to improve and customize our Services and your experience; to allow you to access and use the Services without re-entering your username or password; and to count visits and understand which areas and features of the Services are most popular. We may also associate the information we store in cookies with Personal Information you submit while on our Services. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from websites you visit. Why do we collect the information we collect?

We collect and use Personal Information for lawful business purposes: (i) as necessary for the performance of our contract with You, (ii) for our legitimate interests, so long as they are not overridden by your own rights and interests, or (iii) as required by law. These purposes include providing You with the Service, performing marketing, conducting research, supplying other administrative Services (e.g., setting up new accounts and maintaining your existing account), responding to inquiries, and supporting our legitimate interests to conduct business with You. In addition, we may from time to time review your usage of the Service to be able to better provide you with information about products or Services that we believe may be of interest to you and to inform our efforts to improve the product to your specific needs.

You may request that we stop tracking or collecting your Personal Information by emailing dataprotection@ycharts.com. In such cases your ability to utilize the product will cease and your account information will be erased, as long as local rules and regulations allow YCharts to do so.

How do we use the information we collect?

We may use your Personal Information for the purposes for which it was collected or as otherwise described in this Privacy Policy. In general, we may use your Personal Information for the following purposes:

  • Services and Support – to provide, operate, administer, and support our Services, including by creating and administering your account.
  • Account Management, Billing, and Personalization – to enable you to make a purchase, communicate with you, verify your identity, personalize the content you receive, and administer our relationship with you or your employer.
  • Community and Connectivity – to operate our feature, Communities, which enables you to connect with and follow other users, such as asset managers. This includes providing insights, and, where you have opted in, sharing analytics with other Community participants as described in this Policy. We use data about you to personalize our Services, such as by recommending relevant content and connections.
  • Monitor, Develop, and Improve the Services – to monitor your use of the Services, conduct research, and develop and improve the features and functions of our Services.
  • Safety, Protection, and Enforcement of Rights – to protect your, our, or third parties’ networks, systems, property, or safety, and to enforce our contracts, terms, and conditions.
  • Comply with Applicable Laws and Lawful Requests – to comply with laws and regulations that apply to us and to respond to requests from regulatory agencies, law enforcement, and other public and government authorities.
  • Deidentified or Aggregated Data – to generate deidentified or aggregated data for research, analytics, and product development.
  • Corporate Transactions – to participate in any merger, acquisition, sale, restructuring, or other corporate transaction.
  • Zoom External Messaging Service – we may use Zoom to message with customers and potential customers, where we have appropriate consent to send text messages (SMS).

Using the e-mail addresses provided by users who register for an account with us, YCharts, its advertisers, affiliates, partners, or third parties may periodically send promotional e-mail. In any case where we might use an e-mail address for this purpose, you will be able to opt-out of promotional e-mails from YCharts, its advertisers, affiliates, partners or third parties. However, by registering for an account with YCharts, you agree that YCharts may contact you by e-mail regarding if you provide your e-mail address or other contact data in connection with a request for product information, YCharts, an advertiser, affiliate, partner or third parties, as applicable, will use that information to contact you.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Message and data rates may apply. You can end messages at any time be replying STOP and get more help by responding HELP.

With whom do we share the information we collect?

We may share your Personal Information as described below:

  • Community Participants – Our Services include a Community feature that allows you to connect and share information with other users, such as advisors and asset managers. It is your choice whether to connect with another user or join a Community dashboard. When you choose to join an asset manager’s dashboard, we will share your profile information (e.g., name, email, firm name) with that asset manager. In addition, we may share detailed analytics about your use of the Services with Community participants, which may include clickstream data, securities you have searched, and portfolio composition information. Any information you share with other users is subject to the privacy policies of those users’ and employers, and we are not responsible for their use of your information.
  • Service Providers – We may disclose the personal information we collect to service providers who perform functions on our behalf, such as IT and website hosting, marketing, customer support, and data storage and analysis.
  • Business Partners and Affiliates – We may disclose the Personal Information we collect to our affiliates, subsidiaries, and business partners. If you entered the Site through a website maintained by one of our partners, your Personal Information may be shared with that partner.
  • In Support of Business Transfers – If we are or may be acquired by or merged with another company, or if any of our assets are or may be transferred to another company, we may disclose the Personal Information we have collected from you to the other company.
  • Compliance and Legal Obligations – We may disclose Personal Information to comply with our legal and compliance obligations and to respond to lawful requests by regulators and law enforcement.
  • Aggregate and Deidentified Information – We may use, disclose, and otherwise process aggregate and deidentified information related to our business and the Services with third parties for quality control, analytics, research, development, and other purposes.
  • Quick Extract – If you use YCharts Quick Extract tool, you understand that the information you provide to us, including personal information of investors, may be processed through our integration with ChatGPT. ChatGPT will use this information only to provide Services to you; your information will be deleted by ChatGPT within 30 days and will not be used to develop or improve ChatGPT. What are my privacy rights?

Depending on your jurisdiction, you may have certain rights regarding your Personal Information. We will not discriminate against you for exercising your privacy rights.

Note that you can always update information collected during registration for a YCharts account by logging into your YCharts account and clicking “manage account”.

You are responsible for the accuracy of your Personal Information, and it is recommended that you periodically check to ensure that yours is accurate.

How we protect Personal Information

Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. That said, we certainly try very hard, employing a variety of organizational, technical and administrative measures to provide a level of security appropriate to the risk associated with the Personal Information you trust us with.

Data Retention

We retain your Personal Information only as long as necessary to accomplish the business purpose for which it was collected or to comply with our legal and contractual obligations, and then securely dispose of that information.
